Everything you need to know about our sales terms.

1. Introduction

  • The Sales Policy governs the ordering of advertising on the Castoola platform and within the environment of selected TV operators and applies to all advertisers.
  • This Sales Policy is valid for the calendar year 2026 and further.
  • The Castoola platform represents a technological solution for managing, distributing and measuring addressable TV advertising in the environments of TV operators, OTT services and other connected devices across different markets.

2. General Terms of Business

Advertising Space Pricing

  • Advertising prices are defined in the official Castoola rate card.
  • Advertising inventory is sold across devices and TV environments of selected operators and their advertising placements.
  • These terms apply to advertising inventory marketed by Castoola across different markets and TV operator environments.

Reservations and Orders

  • Advertising reservations and orders must be submitted in writing at least five (5) working days before the campaign starts.
  • If the reservation is not submitted in time, Castoola reserves the right to postpone the campaign start by up to 48 hours (2 days).
  • The validity period of an offer is 14 days, unless agreed otherwise.
  • Before the first broadcast, the client must confirm the offer via email or official purchase order.
  • The order must contain all necessary information, including:
  • buyer
  • advertiser
  • advertising period
  • campaign value
  • targeting parameters
  • other campaign specifications.
  • Castoola does not accept orders for unidentified clients and will not provide purchasing conditions if the client is not clearly defined. The client may not transfer negotiated advertising conditions and/or advertising space to third parties.
  • Castoola reserves the right to modify advertising inventory availability due to technical limitations, operator editorial decisions or other unforeseen circumstances affecting ad distribution.

Deadlines for Advertising Materials

  • Final advertising materials must be delivered at least two (2) working days before campaign starts.
  • Materials must be delivered electronically to the Castoola account manager.

Cancellation of Advertising Campaigns

  • Campaign cancellations are permitted up to seven (7) working days before the first broadcast.
  • Otherwise, Castoola reserves the right to charge the full value of the cancelled order.
  • If the client has an annual agreement with Castoola, the cancellation fee is 50% of the campaign value for cancellations communicated between 4 and 7 days before the first broadcast.
  • A working day is defined as Monday to Friday between 08:00 and 16:00.

Complaints

  • Castoola accepts complaints only in written form.
  • The complaint deadline is five (5) working days after the campaign start.
  • The client must consider the technological characteristics of the broadcasting environment. Errors resulting from poor materials or corrections communicated by phone are the responsibility of the client.
  • Complaints will not be accepted for materials delivered after the specified deadlines.
  • Castoola will respond to complaints within eight (8) working days of receipt.

Obligations for Advertising Agencies and Media Buyers

  • Obligations and cooperation conditions with advertising agencies and media buyers are defined separately in cooperation agreements.
  • Any agreement regarding advertising share distribution between advertisers and/or agencies are prohibited.
  • Any unilateral statement by an advertiser or agency regarding the planned investment share in Castoola advertising has no influence on discounts or commercial conditions.

Advertising Content

  • Advertising content must comply with:
  • applicable legislation
  • advertising standards
  • media regulations of the country where the campaign is broadcast.
  • The advertiser is solely responsible for the advertising content.
  • If advertising content conflicts with operator policies or competitive interests, the operator has the right to reject the advertisement.
  • Advertising materials must be adapted to the language of the market where the campaign is broadcast, if necessary.

Purchase Conditions (Discounts)

  • Clients may receive package discounts when booking multiple campaigns within a one-year period.
  • Commercial conditions are based on the principle of equal treatment of clients.
  • Discount levels must be economically justified and based on measurable criteria.
  • When an agency participates in a pitch representing a potential advertiser, Castoola is not obliged to disclose purchasing conditions due to confidentiality obligations.
  • Castoola reserves the right to modify the published Sales Policy. Partners will be notified via email communication from their account manager.

Agency Commission

  • Agency commissions are calculated based on the annual realized advertising value according to mutual agreement between Castoola and the advertiser or media agency.

3. Advertising Price List

  • The price list defines the cost of advertising across devices and TV environments of individual operators.
  • Advertising prices are expressed in EUR and calculated per 1000 impressions (CPM – Cost per Mille).
  • Prices do not include VAT. VAT, and other applicable taxes are charged according to the legislation of the country where the service is provided.
  • If an advertisement promotes two or more different companies or products, Castoola may charge an additional up to 70% depending on the advertising placement.
  • Campaign broadcasting requires approval from Castoola and the operator. If the content is not approved, Castoola reserves the right to reject the advertisement at any stage of the campaign process.
  • Campaign performance data is based on Castoola platform measurement systems and operator data, which represent the official basis for campaign reporting and billing.

Purchase Conditions

  • The basic targeting unit for advertising is households or devices within households with IPTV access and consent for addressable TV advertising.
  • Castoola commits to defining an approximate audience size and guaranteed number of impressions within campaign offers.
  • Over-delivery or under-delivery of impressions within a campaign period does not constitute a basis for renegotiation in the following year.

Multi-Advertiser Campaigns

  • If an advertisement features two or more companies, Castoola may apply an additional charge of up to 70%.
  • The surcharge is determined based on:
  • number of advertisers
  • type and scope of promoted products
  • length and visibility of product placements
  • other advertising parameters defined in the Sales Policy.
  • The surcharge cannot exceed 70%.
  • Clients must inform Castoola in advance if additional advertisers appear within the advertisement.

Discounts and Added Value

  • Castoola may apply special commercial incentives depending on campaign circumstances.
  • Campaign pricing may also depend on:
  • seasonality of advertising demand
  • campaign timing during the year
  • type of addressable TV advertising used.
  • Client history and previous cooperation performance may also influence final pricing.

4. Content and Technical Requirements

  • Advertisements must be delivered in HD resolution and according to Castoola advertising format specifications.
  • The advertiser is fully responsible for the accuracy and legality of advertising claims and must indemnify Castoola against any third-party claims related to advertising content.
  • Advertisers confirm that they possess all necessary copyright and licensing rights for the materials used in advertisements.
  • Advertising materials must comply with Castoola technical specifications.
  • Castoola reserves the right to place the Castoola logo on advertising creatives for promotional purposes.
  • Castoola is not responsible for interruptions in advertising delivery caused by technical issues related to operators, infrastructure or other external technological factors.

5. Payment Terms

  • Castoola will issue invoices payable within 8 working days after the final broadcast or monthly order completion.
  • The invoice includes a campaign performance report, including:
  • impressions
  • clicks
  • CTR
  • geo-location
  • distribution by device and TV environment.
  • New clients may be required to prepay advertising before campaign launch.
  • Late payments may result in statutory interest charges and suspension of advertising services.

6. Non-Fulfilment of Contractual Obligations

  • If Castoola broadcasts an incorrect advertisement due to its own fault, the client is entitled to free additional broadcasting of the correct advertisement.
  • If the agreed advertising budget is not fulfilled, financial reconciliation may be achieved.

7. General Provisions

  • Castoola’s total liability related to advertising services is limited to the value of the respective advertising campaign.
  • All commercial agreements between agencies, advertisers and Castoola are considered confidential information.
  • Disputes shall be resolved before the competent court in the Republic of Slovenia.
  • These terms are governed by Slovenian law.

8. Regional Validity of Terms

  • Commercial conditions, including pricing, inventory availability and agency commissions, may vary depending on:
  • market
  • audience size
  • agreements with TV operators or partners.
  • Castoola may provide advertising services directly or through partner TV operators, platforms or technology partners.
